The NSW Fair Trading Department gazetted Product Safety Standards for Motorcycle Helmets during the period 1988 to 2007
The standards reflected the Commonwealth regulations gazetted under the ACCC/Trade Practices Act.
In 2010 the helmet standard was removed in the change to Australian Competition Law (ACL), ACCC CPN 9 now applies directly.
The detail for the legislation is listed below followed by the content of the regulation.
Schedule 7 Protective helmets for motor cyclists
1 Definitions
In this Schedule:
AS 1698 means the Australian Standard entitled AS 1698-1988, Protective helmets for vehicle users, as published by Standards Australia on 9 May 1988.
protective helmet means a helmet designed to mitigate the adverse effects of a blow to the head.
2 Safety standard
The product safety standard prescribed for protective helmets for use by motor cyclists is that they must comply with AS 1698.
3 Variation of AS 1698
For the purposes of this Division, AS 1698 is taken to have been amended as follows:
(a) by omitting from Clause 4.4 the matter “AS 1609” and by inserting instead the matter “AS 1609—1981”,
(b) by omitting Clause 8 (g).
Until 2007 the road rules specified the standard for an approved helmet was "set by another law of the jurisdiction".
This is the rule which was intended to be referred to in the road rules.
Clause 8 (g) referred to above removes the ability of regulatory authorities to require external labels
ie up to 2007 external certification stickers were not required as per ACCC CPN 9
