The helmet regulations are set directly in part 2 of the Road Rules Act, Rule 8

Helmets for persons on motor cycles
(1)
A helmet for a person driving or riding on a motor cycle is of an approved type if it:
(a)
complies with Australian Standard AS/NZS 1698:2006 "Protective Helmets for Vehicle Users"; or
(b)
is of a type approved by the Registrar.

There were no known gazetted regulations approved by the Registrar allowing other standards until the gazettes below.

APPROVAL OF HELMETS FOR USE BY PERSONS ON MOTORCYCLES

I, PAUL NATHAN RAJAN, Registrar of Motor Vehicles, approve any helmet that complies with Australian Standard AS1698-1988 "Protective Helmets for Vehicle Users" as a helmet of an approved type for the purposes of regulation 8(1)(b) of the Traffic Regulations and the definition of approved motor bike helmet in Australian Road Rule 270(3)

Approval of Helmets for use by Persons on Motor Cycles

I, Paul Nathan Rajan, Registrar of Motor Vehicles, approve any helmet that complies with the United Nations Economic Commission for Europe (“ECE”) Regulation No. 22 Uniform Provisions Concerning the Approval of Protective Helmets and their Visors for Drivers and Passengers of Motor Cycles and Mopeds, incorporating the 05 series of amendments to that regulation (commonly referred to as “ECE 22.05”), and any further amendments approved and published by the ECE from time to time, or any later version of that regulation, as a helmet of an approved type for the purposes of regulation 8(1)(b) of the Traffic Regulations and the definition of approved motor bike helmet in Australian Road Rule 270(3).
