Declaration of Variation to Rule 270 of the Road Safety Road Rules 2009
Under Section 96A of the Road Safety Act 1986

I, Terry Mulder MP, Minister for Roads, being the Minister responsible for administering the Road Safety Act 1986, declare under section 96A(1)(b) of that Act that road rule 270 of the Road Safety Road Rules 2009 is varied in the manner set out in this declaration.

Commencement

This declaration comes into effect on the date on which it is published in the Victoria Government Gazette.

Variation of road rule 270

Road rule 270 of the Road Safety Road Rules 2009 is varied by inserting the following subregulation after road rule 270(1) –

‘(1A) Subrule (1)(a) does not apply to "Rider Name" of "Rider Address", if "Rider Name" is –

(i)
wearing a Vega NT200 motor bike helmet that is securely fitted and fastened on his head; and
(ii)
carrying a copy of this declaration published in the Victoria Government Gazette at all times while wearing his Vega NT200 helmet in Victoria, and produces the copy of the declaration upon request to any member of the police force of Victoria.’.

Expiry

This declaration expires on that date that is one year after the date of its commencement.

Comment

The exemption above from Victorian Road Rule 270 has recently been gazetted. The name of the rider has been omitted from the copy here for privacy reasons. It highlights the absurdity of the current State Road rules with regard to motorcycle helmets.

Firstly that any exemptions are not added as endorsements to a rider's licence.

Secondly that an NSW rider has felt the need to obtain an exemption in another state rather than the states recognising exemptions given in a riders home state as they are required to do under the constitution and mutual recognition legislation.

Thirdly that an exemption is needed to be publically gazetted in a manner that exposes the rider's name and home address rather than the name being added to a register accessible by police and regulatory authorities.

Lastly that the onus is on the rider to carry a copy of the gazette rather than it being placed into the police and regulatory information system.

The Vega NT200 is UNECE and DOT approved and seems to have very small and very large sizes available.

The system is a farce.
